RULES AND REGULATIONS
MALTA FESTIVAL IN POZNAN

§ 1
GENERAL PROVISIONS

1. These Terms and Conditions set out the rules governing the organisation, order, safety, participation and conduct during the Malta Festival, which will take place from 21 to 28 June 2026 in Poznań (hereinafter referred to as the “Festival”).

2. The organisers of the Festival are:

· dFlights sp. z o.o., with its registered office in Warsaw, address: ul. Krucza 24/26, 00-526 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, under KRS No. 0000721652, NIP: 6772432524, REGON: 369620432 (hereinafter also referred to as “dFlights”),

· Kulczyk Foundation with its registered office in Warsaw, address: ul. Krucza 24/26, 00-526 Warsaw, entered in the register of associations, other social and professional organisations, foundations and independent public healthcare institutions of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, KRS: 0000471002, NIP: 7010414847, REGON: 147124722 (hereinafter also referred to as the “Kulczyk Foundation”).

3. These Terms and Conditions apply to all persons taking part in the Festival or in individual Events forming part of its programme, regardless of whether they hold a Ticket or not, including persons temporarily present on the Festival Grounds, observers, listeners and the general public (hereinafter referred to as “Participants”).

4. These Regulations apply to the Festival as a whole, as well as to each Event organised as part of its programme separately, and should be treated as general regulations; in addition, individual Events or aspects of the Festival’s organisation may be subject to separate specific regulations, i.e. the Festival Regulations. Participants may familiarise themselves with the content of these regulations on the Festival Website or at the venues of individual Events taking place as part of the Festival.

5. Participation in the Festival or in individual Events constitutes acceptance of the Regulations and an obligation to comply with their provisions.

§ 2
DEFINITIONS

The terms used in these Regulations shall have the following meanings:

· Terms and Conditions – these Terms and Conditions,

· Festival Regulations – all regulations in force during the Festival, including, amongst others, the Ticket Sales Regulations, the Regulations on the Granting of Accreditation to Media Representatives, Rules for individual events taking place as part of the Festival and the Festival Partners’ rules applicable during the Festival – e.g. the eBilet sales rules, published on the Festival Website, on the Festival Partners’ websites or at the Festival Site in a visible manner on noticeboards or display boards at the Event venues,

· Malta Festival or the Festival – a cultural festival held annually in Poznań, featuring artists from Poland and around the world, the 36th edition of which will take place from 21 to 28 June 2026 in Poznań,

· Event(s) – performances, street shows, operas, exhibitions, concerts, panels, screenings, performances, as well as other cultural or social events involving an audience, which will take place as part of the 36th edition of the Festival on the streets,
in parks and cultural institutions in Poznań, some of which are mass events within the meaning of the relevant legal provisions,

· Ticket(s) – any type of paid admission ticket to an Event (invitations or passes do not constitute Tickets),

· Festival Partners – natural persons, legal persons or organisational units without legal personality which cooperate with the Organisers in organising the Festival, have been granted the title of Festival Partner by the Organisers, or are Festival sponsors,

· Festival Website – the website operated by the Organisers at: malta-festival.pl,

· Festival App – the Malta Festival mobile app, through which users can access all information about the Festival, including the programme, news and interesting facts,

· Festival Programme – the Festival programme published by the Organisers on the Festival website, including the title, a brief description, time and venue of each cultural, social or artistic event taking place as part of the Festival,

· Minor – a person under the age of 18,

· Guest – a person invited by the Organisers or their partners on the basis of an individual invitation,

· Media representatives – accredited, professionally active representatives of the press, including magazines, radio, television, online media, and photo agencies, as well as social media creators, bloggers, vloggers and other freelancers involved in the dissemination of information, who have obtained press accreditation from the Organisers,

· Festival Site – any location where an Event organised as part of the Festival programme takes place,

· Security and Information Staff – means, amongst others, employees of personal or property security agencies, volunteers, associates and staff employed to assist the audience, authorised to control Participants’ access to the Event, ensuring the safety of Festival Participants, upholding the rules of order and the Festival Regulations, and authorised to provide necessary information regarding the Festival. Members of the Security and Information Services shall wear identification badges displayed in a visible place to enable their identification.

· Force majeure – an event beyond the Organisers’ control which prevents the Event or Festival from taking place. Force majeure includes, in particular: atmospheric phenomena (such as storms, heavy rain causing flooding), natural disasters, failures or disruptions to the operation of equipment supplying electricity, heat, light, pandemics or epidemics, terrorist threats, other threats to the safety and health of people and animals, destruction of property, acts of war or actions by public authorities within the scope of their powers preventing the organisation of the Event, including states of emergency, bans and restrictions imposed by them.

§ 3
RULES FOR ADMISSION TO THE EVENT

1. Admission to the Festival is subject to the type of Event – upon presentation of a valid Ticket (in paper or electronic form, including via a mobile app), journalist accreditation, an invitation, a pass, or other required documents; and in the case of non-ticketed events – without a Ticket, upon presentation of any other documents required for admission to the Event.

2. A Ticket entitles the holder to a single entry to the relevant Event.

3. Admission to Events is controlled by Security and Information Staff.

4. The Festival Organisers and Partners do not sell passes for the entire Festival or passes valid for one or more days of the Festival.

5. The main partner for the sale of tickets for Festival Events is eBilet Polska sp. z o.o., registered office: ul. Żelazna 51/53, 00-841 Warsaw, VAT No.: 951 237 67 01.

6. Admission to the Event for children under the age of 3 is free of charge and requires the legal guardian to present only a document confirming the child’s age and to provide the child with noise-cancelling headphones.

7. Admission to the Event for persons with disabilities requires, in addition to a valid Ticket, the presentation of a current certificate of disability.

8. Admission to the Event for a carer of a person with a disability is free of charge, i.e. it is included in the price of the Ticket for the person with a disability.

9. The organisers will make every effort to ensure that a seat for the carer of a person
is located near their charge; however, they shall not be liable for the failure to find such a seat – in particular, they shall not be liable for a lack of seats resulting from the seating plan or the layout of the venue where the Event is held, or from the fact that numbered seats have been purchased by other Spectators, thereby preventing a seat swap.

10. In the case of Events taking place in venues with numbered seating, the Participant is obliged to occupy the seat indicated on the Ticket. In the case of venues with unnumbered seating, the Participant may occupy a seat of their choice within the sector corresponding to the category indicated on the Ticket.

In all other respects, the rules governing the sale of Tickets for ticketed Events taking place as part of the Festival are set out in the Ticket Sales Regulations.

§ 4
RULES OF ORGANISATION, SAFETY AND ORDER

1. Participants are obliged to comply with the rules of organisation and order of the Festival or the Event and not to disrupt the course of the Event, in particular to maintain silence, not to disturb the artists during their performance, other invited persons during their public appearance, and other Participants of the Event.

2. Participants are required to arrive at the venue of the Event on time.

3. Security staff have the right to refuse entry to the Event to any Participant who is late, which is particularly important in the case of indoor events. In the case of an Event where an interval is scheduled, a late Participant will be admitted to the Event during the interval. No refund of the Ticket price, either in full or in part, is payable in the cases described in this paragraph.

4. A parent or legal guardian of a child under the age of 3 is obliged to provide the child with noise-cancelling headphones at their own expense and undertakes to ensure that the child wears them for the entire duration of the Event.

5. Participants who are parents or legal guardians of minors are responsible for ensuring that the minors comply with these Terms and Conditions and are liable for them in accordance with the Civil Code.

6. Bringing in professional photographic or recording equipment and recording the course of the Event (i.e. taking photographs, filming, recording) or live streaming (so-called live streaming) by Participants is prohibited, unless the Organisers have previously (i.e. before the start of the Event) issued the person recording the Event or live streaming it with the appropriate authorisation in written, electronic or documentary form, which mainly applies to accredited journalists. The Organisers shall not be liable for any breach by a person recording the Event or live streaming it of legal provisions relating to the obligation to obtain permission to use an image or the protection of the personal rights of third parties.

7. Only the bringing in and use of cameras in mobile phones, compact cameras (fitted with a non-removable, fixed-focus lens) or zoom lenses, and GoPro cameras (without additional lenses or attachments) for private purposes is permitted.

8. Participants are prohibited from or restricted from entering specially designated areas, access to which is restricted to artists, guests, technical staff or the Organiser’s services.

9. The Organisers ensure the safety and health of Participants by, amongst other things, appointing Security and Information Staff, providing medical assistance and hygiene and sanitary facilities, and designating evacuation routes and access routes for emergency services and the Police. The Organisers ensure fire safety in accordance with applicable legal regulations.

10. Food and drink outlets are to be located within the Festival site
in designated catering areas and at stationary sales points authorised by the Organisers for tickets or other Festival-related products.

11. For reasons of safety, to protect the health and lives of people and animals, and to safeguard property, the following are prohibited during the Festival:

· using mobile phones, laser pointers and other electronic devices in a manner that may disrupt the Event, in particular by emitting sound or visual signals. Participants are required to mute or switch off such devices for the duration of the Event,

· using drones without the Organisers’ permission,

· using any multi-track vehicles, motorcycles, scooters and personal transport devices within the Festival Grounds, such as: electric scooters, electric bicycles, Segways, hoverboards and other similar electrically powered vehicles,

· bringing onto the Festival Site, possessing or using dangerous items or those that may endanger the safety of other Festival Participants, in particular: weapons, poisonous substances, sharp tools or other dangerous items, explosives, pyrotechnic articles, fire- ly hazardous materials, and other items deemed by the Police or security staff to be dangerous or a threat to safety;

· bringing in and consuming alcohol, unless this is permitted as part of a specific Event and takes place in designated areas, or where the alcohol has been purchased from an authorised alcohol sales point operating within the Festival Grounds,

· bringing in and using narcotic or psychotropic substances, unless prescribed by a doctor, which must be demonstrated by means of a valid medical certificate,

· Participants are prohibited from bringing in or consuming their own (i.e. brought by the participants) drinks or meals during the Event, unless permitted by law or recommended by doctors for persons whose health condition requires a specialised diet confirmed by a medical certificate,

· bringing animals onto the premises, with the exception of assistance dogs accompanying disabled persons, whose presence is permitted; however, for certain Events, bringing animals may be permitted provided it does not disrupt the course of the Event,

· damaging greenery, littering the Festival Site, damaging signage and information boards, or damaging facilities and equipment located on the Event Site,

· conducting, without the Organiser’s consent, any commercial, advertising, marketing, promotional or other profit-making activities, as well as fundraising, or inciting participation in any campaigns or events,

or any other conduct contrary to generally applicable law, including indecent behaviour, conduct contrary to the principles of social coexistence, or conduct infringing upon another person’s human and civil rights or personal interests.

12. Event participants are obliged to observe the rules of safety and public order and to comply with the instructions of the Police and the Organisers’ Security and Information Services present at the Event venue.

13. The Organisers reserve the right to refuse entry to the Event or to order any person to leave the Event venue who disrupts the course of the Event; who fails to comply with the instructions of the Security and Information Services or the Police; who breaches these Terms and Conditions or the Festival Regulations or the provisions of generally applicable law, and in any case where safety or health considerations so warrant. No refund of the Ticket price, either in full or in part, shall be payable in the cases described in this paragraph.

14. The Organisers shall not be liable for any damage to property or loss of property occurring before, during or after the Event.

15. The Organisers shall not be liable for items lost or left unattended on the Event premises.

16. The powers of the Police present during the Festival are governed by the Police Act of 6 April 1990 (i.e. as of 16 January 2024; Journal of Laws of 2024, item 145) and include, amongst other things:

· checking people’s identity;

· detaining persons in the manner and in the cases specified in the provisions of the Code of Criminal Procedure and other Acts;

· detaining persons who clearly pose a direct threat to human life or health, as well as to property;

· the use of direct coercive measures.

17. The powers of the security and information services include, amongst other things, the power to:

· checking and verifying individuals’ eligibility to attend the Event, and, if such eligibility is found to be lacking, instructing them to leave the Festival Site,

· inspecting the contents of persons’ luggage and clothing where there is a suspicion that such persons are bringing in or possessing dangerous items or items posing a threat to safety,

· issuing orders to persons disturbing public order or behaving in a manner inconsistent with the regulations of the mass event or the regulations of the venue (site), and, in the event of failure to comply with these orders, instructing them to leave the Festival Site;

· apprehending, for immediate handover to the Police, persons posing a direct threat to property entrusted to security and persons committing prohibited acts;

· in cases provided for by law – the use of direct coercive measures.

18. Security staff may be equipped with, amongst other things:

· hand-held metal detectors,

· other necessary and legally permitted personal protective equipment.

§ 5
RIGHTS AND OBLIGATIONS OF FESTIVAL PARTICIPANTS

1. Festival participants have the right to:

· to remain on the Festival Site during the Event, i.e. from the moment the Site where the Event is taking place is opened until the Event ends,

· obtain information on the location of medical, catering and sanitary facilities, amenities and safety requirements specified by the Organisers or emergency services,

· use the facilities, including hygiene and sanitary facilities and disinfectants, which are made available for general use, in a manner consistent with their intended purpose,

· seek medical assistance,

· use authorised catering outlets and authorised points of sale for Festival-related products.

2. Festival participants may be exposed to continuous noise. Stroboscopic lights, lasers and other types of light and sound effects will also be used during the Festival. The organisers shall not be liable for any adverse health effects that may occur in a participant as a result of prolonged exposure to loud noise or intense light effects.

3. Participation in the Festival constitutes the Participant’s consent to the recording, free of charge, of their image and behaviour using audio-visual recording equipment whilst on the Festival Site, in particular at the venue and during the Event. This consent covers the use of the image in the Organisers’ materials for promotional, archival, documentation and informational purposes. Participation in the Event with a minor constitutes granting the above consent on their behalf.

4. Materials collected whilst recording the course of the Festival may constitute evidence permitting the initiation of criminal proceedings or proceedings in cases of minor offences, or evidence relevant to such ongoing proceedings, and shall be immediately handed over to law enforcement authorities should such a request be made.

5. The official Festival programme is available exclusively on: the Festival Website, the Festival’s or the Organisers’ social media, or on the Festival Partners’ websites. Tickets for Events are sold exclusively in accordance with the Festival Regulations. The Organisers shall not be liable for the sale of Tickets by unauthorised persons or at unauthorised points of sale, or for information regarding the Festival obtained from other sources.

6. The Organisers reserve the right to make changes to the programme or the course of the Festival for valid reasons. Any refund of the equivalent value of Tickets for Events where a change has occurred, or of the venue or time, is possible in accordance with the rules set out in the Ticket Sales Regulations.

§ 6
COMPLAINTS

1. Any complaints regarding the Festival or individual Events may be submitted in writing to the following address: dFlights sp. z o.o., with its registered office in Warsaw, ul. Krucza 24/26, 00-526 Warsaw or to the Organisers’ email address: office@malta-festival.pl within 14 days of the end of the Festival, whereby the date of receipt of the complaint shall be the date of delivery of the written complaint to dFlights via Poczta Polska S.A. or the date of delivery of the email containing the complaint. The Organisers shall consider complaints submitted in accordance with paragraph 1 within 30 days of their receipt.

2. The complaint should briefly describe the incident in question and include the complainant’s details, such as: full name, address, telephone number, email address, as well as any claims related thereto.

§7
PERSONAL DATA

1. The controllers of personal data within the meaning of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) of Event participants, including media representatives, are:

· Festival Organisers: dFlights and the Kulczyk Foundation,

· Festival partners.

2. The personal data of these individuals is processed by the Organisers in accordance with the Privacy Policy available on the Festival Website. The rules governing the processing of personal data by Festival Partners are in accordance with the rules published on their websites or in any other manner made available by them.

§ 8
FINAL PROVISIONS

1. All rights to the name and logo of the Festival and the Organisers are reserved by the Organisers or, under separate agreements, by the Festival Partners or other authorised entities. It is prohibited to use the name and logo of the Festival or the Organisers without the express permission of the Organisers.

2. All information regarding the Festival is available on the Festival Website and in the Festival App.

3. The Organisers shall not be liable for the consequences of Force Majeure, including costs incurred for Tickets, travel, accommodation and meals, in particular where Force Majeure necessitates the cancellation of the Event or the Festival.

4. The Organisers reserve the right to cancel the Event without prior notice for reasons other than Force Majeure. In such a situation, the Organisers shall refund the equivalent of the Ticket price. Purchasers or Festival Participants shall not be entitled to any other claims against the Organiser or Festival Partners, in particular claims for compensation, including reimbursement of travel, accommodation and meal costs, or any other costs incurred in connection with their planned participation in the Event. The rules governing Ticket refunds are set out in the Ticket Sales Terms and Conditions.

5. In matters not covered by these Terms and Conditions, the relevant provisions of generally applicable law shall apply, including the provisions of the Act of 20 March 2009 on the safety of mass events (i.e. Journal of Laws of 2019, item 2171, as amended), the Civil Code, the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204), the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended), the Act on Copyright and Related Rights of 4 February 1994 (i.e. Journal of Laws of 2022, item 2509), fire safety, health and hygiene regulations, and other relevant provisions.

6. Notwithstanding these Regulations, Participants are obliged to comply with the regulations of the venues or institutions where the Event takes place. In the event of any conflict between the provisions of these Regulations and the regulations of the venues or institutions where the Event takes place, the relevant provisions of the regulations of those venues or institutions shall prevail.

7. In the event of any conflict between the content of individual provisions arising from these Terms and Conditions and the provisions contained in the other Festival Regulations, the relevant provisions arising from the other Festival Regulations shall prevail.

8. In the event of any conflict between these Regulations and the provisions of generally applicable law, the provisions of generally applicable law shall apply in this respect.

9. Any issues arising from contradictions regarding the applicable Festival Regulations should be reported as a complaint in accordance with § 6 of the Regulations.

10. Any questions or comments regarding the Regulations should be sent to the email address office@malta-festival.pl.

11. The Organisers reserve the right to amend the Regulations. Any amendments to the Regulations shall come into force on the date specified by the Organisers on the Festival website. The Organisers undertake to notify participants of any amendments to the Regulations via the Festival website.

12. These Rules and Regulations shall come into force on 26 January 2026.
