TICKET SALES TERMS AND CONDITIONS
for ticketed events
organised as part of the 36th edition of the Malta Festival in Poznań
from 21 to 28 June 2026
(hereinafter referred to as: “Terms and Conditions”)

GENERAL PROVISIONS

§ 1
SUBJECT OF THE TERMS AND CONDITIONS

These Terms and Conditions set out the rules governing the sale, complaints and refunds of admission tickets for events taking place as part of the 36th edition of the Malta Festival, as well as the rules governing audience participation in ticketed events. 

§ 2
DEFINITIONS

The terms used in these Regulations shall have the following meanings: 

1. Terms and Conditions – these Terms and Conditions, 

2. Malta Festival – a cultural festival held annually in Poznań, featuring artists from Poland and around the world, the 36th edition of which will take place from 21 to 28 June 2026 in Poznań (hereinafter referred to as the “Festival”),

3. Event(s) – ticketed performances, street performances, operas, exhibitions, concerts, shows, as well as other cultural or social events involving an audience, which will take place as part of the 36th edition of the Festival on the streets, in parks, cultural institutions in Poznań, and other venues designated for the organisation of such events,

4. Ticket(s) – admission ticket(s) to an Event in paper or electronic form, including a Concession Ticket, a Two-Day Ticket, a Pass and an OzN Ticket, 

5. Concession Ticket – a ticket intended for school pupils and students up to the age of 26, subject to presentation of a valid school or student ID card, and for adults over the age of 65. Concession tickets do not apply to music events, 

6. Two-day ticket – a ticket entitling the holder to attend musical events taking place on two selected concert days, specified by the Buyer during the transaction,

7. Disability Ticket – a ticket at the standard ticket price, entitling the holder to admission to the Event(s) together with one accompanying person, intended for a person with a disability who meets one of the following conditions:

a) has a significant or moderate degree of disability confirmed by a current certificate, or

b) uses a wheelchair – regardless of the degree of disability – confirmed by a current certificate, or

c) is a person under the age of 16 with a valid disability certificate.

8. AD Ticket – an additional, free ticket for selected Events intended for a Spectator wishing to use audio description. The ticket guarantees the reservation of headphones necessary for listening to the audio description. 

9. Pass – a 4-day ticket(s) for admission to musical Events – concerts, in paper or electronic form. 

10. Festival Organisers:

· dFlights sp. z o.o., with its registered office in Warsaw, address: ul. Krucza 24/26, 00-526 Warsaw, entered in the Register of Entrepreneurs of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register under KRS No. 0000721652, Tax Identification Number (NIP): 6772432524, National Business Registry Number (REGON): 369620432, share capital of PLN 212,150.00, email address: biuro@dflights.pl (hereinafter also referred to as “dFlights” or “Organiser 1”), 

· Kulczyk Foundation with its registered office in Warsaw, address: ul. Krucza 24/26, 00-526 Warsaw, entered in the Register of Associations, Other Social and Professional Organisations, Foundations and Independent Public Healthcare Institutions of the National Court Register maintained by the District Court for the Capital City of Warsaw in Warsaw, 12th Commercial Division of the National Court Register, KRS: 0000471002, NIP: 7010414847, REGON: 147124722 (hereinafter also referred to as the “Kulczyk Foundation” or “Organiser 2”), 

11. eBilet – company: eBilet Polska Sp. z o.o. with its registered office in Warsaw, address: ul. Żelazna 51/53, 00-841 Warsaw, 13th Commercial Division of the National Court Register under KRS number 0000496514, NIP 9512376701, REGON 147085850, with share capital of PLN 8,470,000, a ticket sales partner for Festival events, 

12. ToBilet – Międzynarodowe Targi Poznańskie sp. z o.o. with its registered office in Poznań, ul. Głogowska 14, 60-734 Poznań, 8th Commercial Division of the National Court Register, under KRS number 0000202703, Tax Identification Number (NIP) 777-00-00-488, share capital – PLN 419,256,000.00, ticket sales partner for Festival events, 

13. Festival Partners – natural persons, legal persons or organisational units without legal personality who cooperate with the Organisers in organising the Festival or have been granted the title of Festival Partner by the Organisers, 

14. Festival Website – the website operated by the Organisers at: www.malta-festival.pl,

15. eBilet Platform – the website operated by eBilet at www.ebilet.pl, through which online ticket sales for Events are conducted, 

16. ToBilet Platform – the website operated by ToBilet at www.ToBilet.pl, through which online ticket sales for Concerts are conducted, 

17. Purchaser – a natural person, a legal person or an organisational unit without legal personality who has purchased a Ticket via the on-site or online sales system, 

18. Bearer – any holder of a Ticket for the Event, 

19. Spectator/Audience – a person or persons attending the Event on the basis of a valid Ticket. 

20. Cultural Institution – an institution whose events are included in the Malta Festival programme, but for which tickets are not sold by the Festival’s ticketing partners.

§ 3
GENERAL RULES FOR TICKET SALES

1. Tickets and Passes for Festival Events are sold online or at physical sales points. 

2. Tickets and Passes are sold by eBilet, ToBilet and other Festival partners (for selected events). The organisers do not sell Tickets or Passes. 

3. Tickets and passes are sold at the locations, times and dates specified by eBilet and ToBilet or by the cultural institutions selling tickets. 

4. Sales of OzN tickets are handled by eBilet or ToBilet via the festival’s accessibility coordinator – Natalia Dąbrowska – if you wish to purchase an OzN ticket, please send an email to: natalia.dabrowska@malta-festival.pl. 

5. All information regarding the location, dates and times of ticket and pass sales can be found on the Festival website and on the websites of the Festival’s other partners. The organisers are not responsible for information regarding ticket sales obtained by buyers from other sources. 

6. In-person sales take place exclusively: 

1) at ticket sales points specifically set up for this purpose and operated by eBilet, or 

2) at eBilet’s permanent stationary sales points: https://www.ebilet.pl/centrum-pomocy/zakup/stacjonarne-punkty-sprzedazy/lista-punktow-sprzedazy

3) at the ticket offices of cultural institutions (e.g. at the theatre where the performance is taking place) 

– in this way, the Buyer purchases a Ticket and/or Pass in paper form. 

7. The sale of tickets and passes via electronic means takes place exclusively through the eBilet and ToBilet platforms, whereby Buyers may purchase Tickets and/or Passes online by visiting the website www.malta-festival.pl, from which they will then be redirected to the eBilet and ToBilet platforms, with the exception of the sale of tickets for Cultural Institution Events conducted via the Cultural Institution’s own sales platforms. The purchased Ticket and/or Pass will be sent to the Buyer in electronic form to the email address provided at the time of purchase, or in paper form if the Buyer chooses to have the Ticket and/or Pass sent to them in physical paper form, e.g. to a parcel locker or via courier. 

8. Online sales of Tickets and Passes end no later than 30 minutes before the start of the Event. 

9. Tickets and Passes sold are bearer documents. No named tickets are sold for Events. 

10. The Buyer may purchase a maximum of 3 Tickets or Passes in a single transaction. 

11. The date of sale of a Ticket and/or Pass is deemed to be the date on which payment is received by the entity conducting the sale (in the case of bank transfers – the date on which the funds are credited to the account of the entity conducting the sale). 

12. Ticket and Pass prices are quoted in Polish zlotys and include the applicable VAT (they are gross prices). Tax rates may vary depending on the entity selling the Tickets and Passes, which may result in a difference in the price of Tickets and Passes sold for the same Event. 

13. Payment for Tickets and/or Passes purchased via eBilet and ToBilet is made in accordance with the terms and conditions set out by eBilet and ToBilet. 

14. VAT invoices are issued at the Buyer’s request, submitted to the entity selling the Ticket and/or Pass within the timeframe specified in its applicable terms and conditions. In the case of VAT invoices for companies or institutions, the Buyer is required to provide their tax identification number (NIP) prior to making payment. 

15. Tickets and Passes may not be photocopied, scanned or copied in any other way – should such conduct be detected, the Ticket shall cease to be valid. 

16. Passes and two-day Tickets must be exchanged for a wristband upon first entry, which confirms the right to attend the Event for its entire duration.

17. The wristband is assigned to a single person and must not be removed, transferred or made available to third parties.

18. Damage to, loss of, or failure to present the wristband may result in refusal of re-entry to the Event venue.

19. Sharing a Pass/Two-Day Ticket with other people is prohibited.

20. It is not possible to change the dates specified when purchasing a Two-Day Ticket.

21. The purchaser is obliged to check the Ticket, Two-Day Ticket and/or Pass for accuracy regarding the date, time, quantity and price, and in the event of any discrepancies, to report this immediately to the Organisers at bilety@malta-festival.pl or eBilet and ToBilet. 

22. The purchase of Tickets, Two-Day Tickets and/or Passes at auctions, tenders, competitions, or for profit outside the aforementioned points of sale, outside the eBilet and ToBilet platforms or the Festival website is prohibited. 

23. Tickets, two-day tickets and season tickets may only be sold at the price set by the entities selling tickets for the events referred to in paragraph 2 above. 

24. The purchase of tickets for artistic or entertainment events for the purpose of resale at a profit, or the sale of such tickets at a profit, constitutes an offence under Article 133 of the Code of Misdemeanours, which is punishable by imprisonment, restriction of liberty or a fine. The same penalty shall apply to attempting, inciting or aiding and abetting the commission of the act referred to in the preceding sentence. 

§ 4
RULES FOR ENTRY TO THE EVENT

1. Admission to the Event is granted upon presentation of a valid Ticket, Concession Ticket, Two-Day Ticket, Pass or OzN Ticket.

2. Each Ticket, Concessionary Ticket or OzN Ticket referred to in paragraph 1 above entitles the holder to a single entry to the Event. 

3. Admission to the Event for children under the age of 3 is free of charge; it requires only the presentation of a document confirming the child’s age and is permitted only when accompanied by a guardian. This provision does not apply to Events for which the Organiser has specified a minimum age for participants, as indicated in the Event description.

4. In the case of OzN Tickets, the accompanying person may only enter the Event at the same time as the person with a disability. 

§ 5
RULES OF ORGANISATION AND ORDER IN THE AUDITORIUM

1. Spectators are required to observe the rules of organisation and order in the Audience Area and not to disrupt the course of the Event, in particular to remain silent, not to disturb the artists during their performance, and not to disturb other spectators attending the Event. 

2. Spectators are required to arrive at the venue on time. 

3. The auditorium staff have the right to refuse entry to the Event to any latecomer. In the case of an Event that includes an interval, latecomers will be admitted to the Event by the auditorium staff during the interval. No refund of the Ticket price, either in full or in part, shall be granted in the cases described in this paragraph. 

4. A parent or legal guardian of a child, or another carer acting on the basis of written consent granted by the child’s parents or legal guardians, who attends the Event with a child under the age of 3, is obliged to provide the child with noise-cancelling headphones at their own expense and undertakes to ensure that the child wears them for the entire duration of the Event. 

5. The parents or legal guardians of underage spectators are responsible for ensuring compliance with these Regulations and bear liability for them in accordance with the provisions of the Civil Code. 

6. Recording the course of the Event (i.e. photography, filming, audio recording) and its live streaming (so-called live streaming) by Spectators is prohibited, unless the Organisers have previously (i.e. before the start of the Event) issued the person recording the Event or live streaming it with the appropriate authorisation in written, electronic or documentary form, which mainly applies to accredited journalists. The Organisers shall not be liable for any breach by a person recording the Event or live streaming it of legal provisions relating to the obligation to obtain consent for the use of an image or the protection of the personal rights of third parties. 

7. During the Event, it is prohibited to bring in professional equipment, including cameras, video cameras, tripods and other recording devices. The Organiser reserves the right to refuse entry to persons in possession of such equipment without accreditation or permission granted by the Organiser. 

8. During the Event, the use of mobile phones and other electronic devices that may disrupt the course of the Event, in particular by emitting sound or visual signals, is prohibited. Spectators are required to silence or switch off such devices for the duration of the Event. 

9. Bringing or using weapons, laser pointers, intoxicating substances, psychotropic substances and alcohol during the Event is prohibited. 

10. Participants are prohibited from bringing in or consuming their own (i.e. brought by spectators or other Event participants) drinks or food during the Event. The organisers may introduce separate rules for a given Event by displaying them at the Event venue in a manner visible to spectators or by publishing them on the Festival website. 

11. Bringing animals onto the Event venue is prohibited. For other Events, bringing animals is prohibited unless the regulations of the venue or site where the Event is held state otherwise, and provided that bringing animals does not disrupt the course of the Event. The Organisers may introduce separate rules for a given Event by displaying them at the Event venue in a manner visible to spectators or by publishing them on the Festival website. This clause does not apply to guide dogs or assistance dogs for people with disabilities. 

12. Notwithstanding these Terms and Conditions, Spectators are obliged to comply with the regulations of the venues or institutions where the Event takes place and to follow the instructions of the venue staff or security personnel of the Organisers and/or the Institution. 

13. The Organisers reserve the right to refuse admission to the Event or to order any person to leave the venue of the Event who commits an act of disrupts the course of the Event; who fails to comply with the instructions of the venue staff, the relevant security personnel of the Organisers or the Police; who breaches these Terms and Conditions or generally applicable laws, and in any case where there are grounds of safety or public health. No refund of the Ticket price, either in full or in part, shall be payable in the cases described in this paragraph. 

§ 6
COMPLAINTS AND TICKET REFUNDS

1. The Purchaser is entitled to lodge a complaint in relation to the purchased Ticket. 

2. The complaint will be considered immediately, no later than within 14 days of receipt. 

3. The following must be attached to the complaint: a scan of the Ticket to which the complaint relates, the receipt number (or proof of payment for the Ticket) and a detailed description of the problem. 

4. If the complaint regarding the Tickets is upheld, the Buyer shall, without delay but no later than within 14 working days of being notified of the decision, receive a refund of the Ticket price, or a replacement Ticket free from defects – if this is the subject of the complaint – or a Ticket for another Event within the Festival – at the Buyer’s request, if this is possible given the availability of tickets for that event. The date on which the account of the entity selling the Ticket is debited shall be deemed the date of refund of the Ticket price. 

5. Complaints should be submitted via the eBilet contact form https://www.ebilet.pl/kontakt, or ToBilet https://ToBilet.pl/contact/ for tickets purchased there, or to the Organisers’ email address: office@malta-festival.pl. 

6. Complaints regarding purchases made via the eBilet platform shall be handled by eBilet, and those regarding purchases made via the ToBilet platform shall be handled by ToBilet, in accordance with the terms and conditions set out in their respective regulations. 

7. The Organiser reserves the right to: 

a) cancel the Event, 

b) change the date or time of the Event, 

c) change the venue of the Event, 

d) make changes to the programme (schedule or performers), 

– without giving a reason.

8. A refund of the Ticket price shall be made in the event of: 

a) cancellation of the Event – refunds shall be made in accordance with the rules and procedures set out in the eBilet and ToBilet terms and conditions – in the case of Tickets purchased through these platforms; or within the timeframe and in the manner announced by the Organisers on the Festival website; or in any other manner agreed upon in communication with the Buyer, e.g. via email; 

b) change of date or venue of the Event – if the Organiser does not offer the Buyer a place at the selected event on an alternative date with a value corresponding to that of the originally purchased Tickets, the Buyer shall, upon request, receive a refund of the equivalent value of the Tickets within the timeframe specified in the Partners’ terms and conditions; for other Tickets – within the timeframe and in the manner announced by the Organisers on the Festival website; or, where applicable, in another manner agreed upon in communication with the Buyer, provided that a change in the time of the Event shall not be considered a change in the date of the Event; 

c) the successful resolution of a Ticket complaint – in the event of a decision to grant a refund of the Ticket price.

9. In cases other than those described in the paragraph above, in particular in the event of the cancellation of the Event or a change to the date of the Event due to force majeure, no refund of the Ticket price shall be payable. 

10. The Organisers reserve the right to accept a complaint or refund the Ticket price in full or in part, also for other reasons justified by exceptional circumstances, at the Buyer’s request or on their own initiative. 

11. In the event of a damaged or otherwise defective Ticket being issued, in response to a report made by the Buyer no later than at the time of collecting the Ticket, the Seller shall issue a duplicate Ticket to the Buyer. The Ticket Seller will not consider such a request if the defect in the Ticket is reported after this time, or will issue a duplicate for a fee of PLN 20 (plus any delivery costs). 

12. The Buyer may not withdraw from the Ticket sales contract for reasons other than the successful resolution of a complaint. In the case of an online Ticket purchase, the right under Article 27 of the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2023, item 2759) to withdraw from the Ticket sales contract (see Article 38(12) of the aforementioned Act) shall not apply. 

13. Neither the Purchaser nor the Spectators shall be entitled to any claim for infringement of their personal rights, for compensation for pain and suffering, for damages or any claim related to the cancellation of the Event, a change in its date or venue – other than those described in these Terms and Conditions. 

§ 7
PERSONAL DATA

1. The controllers of personal data within the meaning of the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (hereinafter referred to as the “GDPR”) of Buyers, Spectators and other participants in the Event are: 

a) Organisers: dFlights and the Kulczyk Foundation, 

b) eBilet – in relation to persons purchasing Tickets via the eBilet platform, 

c) ToBilet – in relation to persons purchasing Tickets via the ToBilet platform, 

d) Festival partners – in relation to persons purchasing Tickets at their points of sale. 

2. The personal data of persons purchasing Tickets online via the eBilet and ToBilet platforms is processed in accordance with the principles set out on this website. 

3. The personal data of persons purchasing Tickets at points of sale operated by Festival partners is processed in accordance with the personal data processing policies provided by those entities. 

§ 8
FINAL PROVISIONS

1. The purchase of a Ticket constitutes acceptance of these Terms and Conditions. 

2. The Organisers undertake to comply with generally applicable legal provisions and generally accepted social norms, in particular fire safety regulations and regulations on the safety of mass events – where applicable. 

3. Participation in the Event organised by the Organisers constitutes consent by the participant to the free recording of their image (in particular, photography and filming) during their presence at the venue and time of the Event, and in particular during the Event itself. This consent covers the use of the image in the Organisers’ materials for promotional, archival and informational purposes. Participation in the Event with a child constitutes granting the above consent on behalf of the child. Any refusal to consent to publication must be reported upon entry to the Organisers’ Event and to the venue staff. 

4. In matters not covered herein, the provisions of generally applicable law shall apply, in particular: the Civil Code, the Act on the Provision of Electronic Services of 18 July 2002 (Journal of Laws No. 144, item 1204), the Act of 30 May 2014 on Consumer Rights (Journal of Laws of 2014, item 827, as amended) and the Act on Copyright and Related Rights of 4 February 1994 (i.e. Journal of Laws of 2022, item 2509). 

5. Any questions or comments regarding the Terms and Conditions should be sent to the email address office@malta-festival.pl.

6. The Organisers reserve the right to amend the Terms and Conditions. Any amendments to the Terms and Conditions shall come into force on the date specified by the Organisers on the Festival website. The purchase of a Ticket prior to the date on which the Terms and Conditions or any amendments thereto come into force shall be governed by the provisions in force on the date of purchase of the Ticket, and in the absence of the Terms and Conditions on that date – by the terms and conditions referred to in 7 and 8 below – to the extent that they apply. In the event of an occurrence (e.g. a Ticket refund, a complaint) described in the Terms and Conditions, the provisions of the Terms and Conditions in the version in force on the date of such occurrence shall apply. The Organisers undertake to notify users of any amendment to the Terms and Conditions via the Festival website. 

7. The sale of Tickets online is governed by the terms and conditions of the eBilet and ToBilet platforms, and only in matters not covered therein – by the provisions of these Terms and Conditions. 

8. The sale of Tickets by Cultural Institutions and other (non-eBilet and non-ToBilet) Festival partners shall be governed by those partners’ Ticket sales terms and conditions, where applicable, and only in matters not covered therein, or in the absence of such terms and conditions – by the provisions of these Terms and Conditions. 

9. In the event of any conflict between the content of these Terms and Conditions and the terms and conditions of the eBilet and ToBilet platforms regarding tickets purchased through them, the rules set out on the eBilet and ToBilet platforms shall apply in this respect. In the event of any conflict between the provisions of these Terms and Conditions and the terms and conditions of sale applicable to other Festival partners selling Tickets, the terms and conditions of the Festival partners shall apply in respect of tickets purchased through them. 

10. In the event of any conflict between these Terms and Conditions and the rules and regulations of the venues or institutions where the Event is held, the provisions of the rules and regulations of those venues or institutions shall prevail. 

11. In the event of any conflict between these Regulations and the provisions of generally applicable law, the provisions of generally applicable law shall apply in this respect. 

12. These Terms and Conditions, as set out above, shall enter into force on 26 January 2026.
